3. Submission of Application a. Detailed guidance on the SBA Loan System submission process can be found in the 504 User Guide for submitting loan applications, posted on SBA’s website. CDCs may choose to either use a vendor solution that integrates with the Capital Access Financial System (CAFS) loan platform or manually use the SBA Loan System web screens. Documents greater than 250MB must be separated into multiple documents. The system does not support uploads greater than 250MB. b. Regardless of the processing method used: i. CDCs must retain the full application in its file. ii. One hundred percent of the Applicant’s ownership and percentage of ownership must be disclosed in the SBA Loan System. c. Non-delegated and not using ASM CDCs processing a loan under non-delegated authority and not using ASM must submit all items in Paragraph 2.a. above into the SBA Loan System for loan approval by SLPC. d. ASM i. Submit items in 2.a.i. through 2.a.xiv above into the SBA Loan System for loan approval by SLPC. ii. Applications for projects that result in change of ownership or transactions between close family members cannot be processed under ASM. e. ALP Express Loans f. The ALP CDC must upload into the SBA Loan System the ALP Express Loan application, including the exhibits identified in the SBA Form 1244 required for ALP Express Loans. ALP CDC must retain all other exhibits in the loan file. g. The ALP CDC must indicate on SBA Form 1244 (page 10) that it is submitting the loan as an ALP Express Loan. If the ALP CDC does not designate on SBA Form 1244 that the ALP CDC is using the ALP Express submission method, SBA will process the loan as a standard 504 loan. h. SLPC will review each complete ALP Express Loan application for eligibility and communicate any eligibility issues to the CDC for resolution. ALP CDCs must continue to obtain SBA’s approval involving certain program eligibility requirements, including but not limited to those requirements involving historic properties, all environmental documents, and businesses involving activities of a prurient sexual nature. i. SLPC will not review the ALP CDC’s credit decisions for any application submitted using the ALP Express delegated authority. SLPC will review the appraisal, as needed, to determine eligibility. SLPC will not review the life insurance requirements, which is a credit and collateral responsibility of the ALP CDC. j. ALP CDCs must submit to the SLPC for review and approval any servicing action that the ALP CDC proposes prior to closing that may affect the eligibility of the borrower or the ALP Express Loan. k. Once SLPC determines the applicant and the loan are eligible and that SBA funds are available for the loan, the SLPC will issue an SBA Loan Number and will update the SBA Loan System with the Terms and Conditions of the 504 Loan. l. ALP Express Authority may not be used in the following circumstances: m. Previously Declined/Withdrawn Loans: ALP Express authority may not be used to process 504 loans previously submitted to SBA and withdrawn by the CDC or declined or otherwise not approved by SBA. An ALP CDC must review the borrower certification on SBA Form 1244 to ascertain whether the 504 loan was previously submitted to SBA and confirm with SLPC whether the loan was previously withdrawn by the CDC or was declined or otherwise not approved by SBA. n. Exceptions to Policy: Any 504 loan that will need an exception to policy may not be processed as an ALP Express Loan, and must be submitted to SBA through SLPC in accordance with this SOP. o. Increase over $500,000: An ALP Express Loan may not be increased over $500,000. Any increase above $500,000 would require the ALP Express Loan to be cancelled and resubmitted as a non-delegated loan through SLPC. p. Premier Certified Lenders Program (PCLP) Loans The PCLP CDC must complete and upload the following documents into the SBA Loan System within 15 business days after debenture funding: i. The final executed SBA Terms and Conditions (updated to reflect the final terms of the loan); ii. SBA Form 1244, “Application for Section 504 Loan.” One hundred percent of the Applicant’s ownership and each owner’s percentage of ownership must be disclosed on SBA Form 1244 (additional sheets may be attached to the Form 1244 if necessary).
